1. Information We Collect

1.1 Personal Information:
When you visit the Site, create an account, sign up for our marketing programs, or place an order, we may collect personal information such as your name, email address, mobile phone number, shipping address, billing address, contact details, and payment information. 3. SMS / Text Message Marketing

3.1 The program. If you provide your mobile phone number and expressly opt in, Rova may send you recurring automated marketing text messages (SMS/MMS) at the number you provide. These may include new product drops, promotions, special offers, back-in-stock alerts, and shopping cart reminders. We may also send service-related messages such as order and shipping updates.

3.2 Consent is voluntary. You do not have to sign up for this program in order to make a purchase. Your consent to receive marketing text messages is not a condition of any purchase with Rova, and participation is entirely voluntary.

3.3 Frequency and cost. Message frequency varies. Message and data rates may apply. We do not charge for the program, but you are responsible for any charges imposed by your wireless carrier. Please check your mobile plan and contact your carrier for details.

3.4 How to opt out. You may opt out at any time by replying STOP to any text message you receive from us, or by using the unsubscribe link where one is provided. You will receive a single confirmation message, after which we will stop sending you marketing text messages. For help, reply HELP to any message from us or email hello@rovabuilds.com.

3.5 What we collect and why. To operate this program we collect and use your mobile phone number, your opt-in and opt-out status, the date and method of your consent, and records of the messages we send you and your responses to them. We use this information solely to deliver the messages you have asked for, to honor your opt-out requests, to measure how the program performs, and to comply with our legal obligations.

3.6 Who we share it with. We share your mobile phone number only with the service providers who deliver these messages on our behalf — our messaging platform and the wireless carriers and messaging aggregators required to transmit them — and only for the purpose of operating the program. We do not sell, rent, or share text message originator opt-in data or consent with any third party for that party's own marketing purposes. This information is excluded from any data sharing or sale described elsewhere in this Privacy Policy.

3.7 Age. You must be at least 18 years old to consent to receive marketing text messages from Rova.

3.8 Additional terms. Your use of the text message program is also governed by our Mobile Terms of Service.

4. Sharing Personal Information

4.1 We share your Personal Information with service providers to help us provide our services and fulfill our contracts with you. For example, we use Shopify to power our online store. You can read more about how Shopify uses your Personal Information here: Shopify Privacy Policy.

4.2 We may also disclose your information to comply with applicable laws and regulations, to respond to a subpoena, search warrant, or other lawful requests for information we receive, or to otherwise protect our rights.

4.3 The sharing described in this section excludes text messaging originator opt-in data and consent; this information will not be shared with any third parties.

5. Data Security

5.1 We take reasonable measures to protect your personal information from unauthorized access, alteration, disclosure, or destruction. However, no method of transmission over the internet or electronic storage is 100% secure. We cannot guarantee the absolute security of your data.

6. Cookies, Tracking Technologies, and Abandoned Carts

6.1 We use cookies and similar tracking technologies to enhance your browsing experience, analyze website traffic, and gather information about how you interact with our website. You can manage your cookie preferences through your browser settings. See Section 18 for more detail on the cookies we use.

6.2 Abandoned carts. Rova's website uses cookies and similar technologies to keep track of the items you put into your shopping cart, including when you have added items and left the Site without completing your purchase. This information is used to determine when to send you cart reminder messages by email and, where you have opted in, by text message. If you do not wish to receive these reminders, you can unsubscribe from our emails or reply STOP to any text message, as described above.

7. Links to Third-Party Websites

7.1 Our website may contain links to third-party websites or services that are not operated or controlled by Rova. This Privacy Policy does not apply to those third-party websites. We encourage you to review the privacy policies of those websites before providing any personal information.

8. Children's Privacy

8.1 Our website is not intended for use by children under the age of 16, and you must be at least 18 to purchase from us or to consent to receive marketing text messages. We do not knowingly collect personal information from children. If you believe that we may have inadvertently collected personal information from a child, please contact us immediately.

10. Lawful Basis

10.1 Pursuant to the General Data Protection Regulation ("GDPR"), if you are a resident of the European Economic Area ("EEA"), we process your personal information under the following lawful bases:

  • The performance of the contract between you and the Site;
  • Compliance with our legal obligations;
  • To protect your vital interests;
  • To perform a task carried out in the public interest;
  • For our legitimate interests, which do not override your fundamental rights and freedoms.

11. Retention

11.1 When you place an order through the Site, we will retain your Personal Information for our records unless and until you ask us to erase this information. For more information on your right of erasure, please see Section 17 ("Your Rights") below.

11.2 Where you have opted out of marketing communications, we retain a record of your opt-out so that we can continue to honor it.

12. Automatic Decision-Making

12.1 If you are a resident of the EEA, you have the right to object to processing based solely on automated decision-making (which includes profiling), when that decision-making has a legal effect on you or otherwise significantly affects you.

12.2 We DO NOT engage in fully automated decision-making that has a legal or otherwise significant effect using customer data.

12.3 Our processor Shopify uses limited automated decision-making to prevent fraud that does not have a legal or otherwise significant effect on you.

12.4 Services that include elements of automated decision-making include:

  • Temporary blacklist of IP addresses associated with repeated failed transactions. This blacklist persists for a small number of hours.
  • Temporary blacklist of credit cards associated with blacklisted IP addresses. This blacklist persists for a small number of days.

13. Sale and Sharing of Personal Information

13.1 We do not sell your personal information for money.

13.2 We disclose personal information to service providers who process it on our behalf under contract — for example Shopify (our store platform), Klaviyo (our email and text messaging platform), and our payment processors. These providers may use your information only to perform services for us and not for their own purposes. Disclosures of this kind are not a "sale" of personal information.

13.3 Our Site uses advertising and analytics technologies provided by Meta (Facebook and Instagram), TikTok, and Google. These technologies may disclose limited identifiers, such as cookie identifiers and information about your browsing activity, to those platforms. Certain laws, including the California Consumer Privacy Act as amended by the California Privacy Rights Act, treat disclosures of this kind as "sharing" personal information for cross-context behavioural advertising, even where no money changes hands. You can opt out of this at any time — see Section 16 ("Behavioural Advertising") below.

13.4 We do not knowingly sell or share the personal information of consumers under 16 years of age.

13.5 The above excludes text messaging originator opt-in data and consent; this information is never sold or shared with any third parties.

13.6 Your right to opt out of sharing. You have the right to direct us to stop sharing your personal information for cross-context behavioural advertising. You can exercise this right at any time by using the "Do Not Sell or Share My Personal Information" link in the footer of our website, or by emailing us at hello@rovabuilds.com. We will not require you to create an account in order to exercise this right, and we will not discriminate against you for exercising it.

14. GDPR

14.1 If you are a resident of the EEA, you have the right to access the Personal Information we hold about you, to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased. If you would like to exercise these rights, please contact us through the contact information above.

14.2 Your Personal Information will be initially processed in Ireland and then will be transferred outside of Europe for storage and further processing, including to Canada and the United States. 15. CCPA

15.1 If you are a resident of California, you have the right to access the Personal Information we hold about you (also known as the 'Right to Know'), to port it to a new service, and to ask that your Personal Information be corrected, updated, or erased. If you would like to exercise these rights, please contact us through the contact information above.

15.2 If you would like to designate an authorized agent to submit these requests on your behalf, please contact us at the address above.

16. Behavioural Advertising

16.1 We use the information we collect about you to provide you with targeted advertisements or marketing communications we believe may be of interest to you, and to measure how those advertisements perform. This may involve sharing limited information with advertising partners such as social media and search platforms.

16.2 You can opt out of targeted advertising through the tools provided by those platforms, and through the industry opt-out portals operated by the Digital Advertising Alliance at optout.aboutads.info and the Network Advertising Initiative at optout.networkadvertising.org.

16.3 Text messaging originator opt-in data and consent are never used or shared for behavioural advertising purposes.

17. Your Rights

17.1 Depending on where you live, you may have the right to access the personal information we hold about you, to request that it be corrected or erased, to request a copy of it in a portable format, to object to or restrict certain processing, and to withdraw consent you have previously given.

17.2 To exercise any of these rights, contact us at hello@rovabuilds.com. We will respond within the timeframes required by applicable law. We will not discriminate against you for exercising any of these rights.

17.3 You may withdraw consent to marketing at any time — by using the unsubscribe link in any email, or by replying STOP to any text message.

18. Cookies

18.1 A cookie is a small amount of information that's downloaded to your computer or device when you visit our Site. We use a number of different cookies, including functional, performance, advertising, and social media or content cookies. Cookies make your browsing experience better by allowing the website to remember your actions and preferences (such as login and region selection). This means you don't have to re-enter this information each time you return to the site or browse from one page to another. Cookies also provide information on how people use the website, for instance, whether it's their first time visiting or if they are a frequent visitor.

18.2 The length of time that a cookie remains on your computer or mobile device depends on whether it is a "persistent" or "session" cookie. Session cookies last until you stop browsing and persistent cookies last until they expire or are deleted. Most of the cookies we use are persistent and will expire between 30 minutes and two years from the date they are downloaded to your device.

18.3 Location and currency. By using our website, you agree to allow third-party service providers to process your IP address in order to approximate your location for the single purpose of converting displayed prices into your local currency. You also agree to have that currency preference stored in a session cookie in your browser (a temporary cookie which is automatically removed when you close your browser). We do not use precise geolocation data, we do not track your device's location, and we do not use location data for advertising or for targeting text messages.

18.4 You can control and manage cookies in various ways. Please keep in mind that removing or blocking cookies can negatively impact your user experience and parts of our website may no longer be fully accessible.

18.5 Most browsers automatically accept cookies, but you can choose whether or not to accept cookies through your browser controls, often found in your browser's "Tools" or "Preferences" menu. For more information on how to modify your browser settings or how to block, manage or filter cookies can be found in your browser's help file or through such sites as: www.allaboutcookies.org.

18.6 Please note that blocking cookies may not completely prevent how we share information with third parties such as our advertising partners. To exercise your rights or opt out of certain uses of your information by these parties, please follow the instructions in Section 16 ("Behavioural Advertising") above.

19. Do Not Track

19.1 Please note that because there is no consistent industry understanding of how to respond to "Do Not Track" signals, we do not alter our data collection and usage practices when we detect such a signal from your browser.

19.2 Global Privacy Control. The Global Privacy Control ("GPC") is a separate and more recent browser signal from "Do Not Track". Where we detect a GPC signal from your browser, we treat it as a valid request to opt out of the sharing of your personal information for cross-context behavioural advertising, as described in Section 13.6, for that browser and device.

20. Notice of Financial Incentive

20.1 From time to time we offer programs that provide something of value — such as a discount code, free shipping, a free gift, or entry into a giveaway — in exchange for your signing up to receive marketing communications from us. Because these programs involve the collection of personal information, they may be considered "financial incentives" under certain privacy laws.

20.2 What we collect. To participate, we collect the information requested at sign-up, which is typically your email address and, where you opt in separately, your mobile phone number.

20.3 How to join and how to withdraw. You opt in by submitting the sign-up form and agreeing to receive marketing communications. You may withdraw at any time by using the unsubscribe link in any email, by replying STOP to any text message, or by emailing hello@rovabuilds.com. Withdrawing may end your participation in the program and any associated ongoing benefit, but does not affect a discount you have already used.

20.4 Why we can offer it. We offer these incentives because customers who join our marketing programs tend, on average, to purchase more frequently over time. We have made a good-faith estimate that the value of the incentive offered is reasonably related to the value of the information you provide, calculated by reference to the expected additional revenue from subscribers relative to the cost of the discount or gift offered.

20.5 No obligation. Participation is entirely voluntary. You do not have to join any marketing program to browse our website or to make a purchase, and we do not charge different prices or provide a different quality of goods to customers who choose not to participate, other than the advertised incentive itself.

21. Changes to this Privacy Policy

21.1 We may update this Privacy Policy from time to time in order to reflect changes to our practices or for other operational, legal, or regulatory reasons. Any changes will be effective immediately upon posting the revised version on our website. We encourage you to review this Privacy Policy periodically.
